Welcome to TownLinc. By accessing or using our web application at townlinc.com ("Service"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Description of Service

TownLinc is a neighborhood carpooling platform that connects neighbors with similar commute routes and schedules. We facilitate introductions and provide tools for coordination—we do not operate a transportation service, employ drivers, or own vehicles.

2. Eligibility

You must be at least 18 years old to use TownLinc. If you intend to drive as part of a carpool arrangement, you must also possess a valid driver's license. By using our Service, you represent that you meet these requirements.

3. User Accounts and Responsibilities

When you register for TownLinc, you agree to:

  • Provide accurate and complete information
  • Keep your contact information current
  • Maintain the confidentiality of your account
  • Be responsible for all activity under your account
  • Notify us immediately of any unauthorized use

Consent to Matching: By submitting your information through our signup form, you consent to being matched and introduced to other TownLinc users with compatible routes. This includes sharing your name, contact information, general neighborhood, destination, and timing preferences with matched carpool partners.

4. Acceptable Use

You agree not to:

  • Provide false or misleading information
  • Use the Service for any unlawful purpose
  • Harass, threaten, or harm other users
  • Use the Service for commercial transportation services
  • Attempt to interfere with or disrupt the Service
  • Collect information about other users without consent

5. Carpooling Arrangements

Your Responsibility:

All carpooling arrangements made through TownLinc are between you and other users. You are solely responsible for:

  • Verifying the identity and suitability of carpool partners
  • Agreeing on schedules, pickup locations, and cost-sharing arrangements
  • Ensuring your vehicle is properly insured, registered, and maintained (if driving)
  • Complying with all applicable traffic laws and regulations
  • Your personal safety and the safety of your passengers

Cost Sharing: Any payments or cost-sharing between carpoolers is a private arrangement between users. TownLinc does not process payments, set pricing, or recommend or enforce any specific cost-sharing arrangement.

No Background Checks: TownLinc does not conduct background checks, driving record checks, or identity verification on users. You are solely responsible for evaluating the suitability of potential carpool partners.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

  • The Service will be uninterrupted or error-free
  • Matches will be suitable or compatible
  • Other users will fulfill their carpool commitments
  • Information provided by other users is accurate

7. Limitation of Liability

TownLinc is not responsible for:

  • The conduct, actions, or omissions of any user
  • Any disputes between carpoolers
  • Vehicle accidents, injuries, or property damage
  • Personal belongings lost or damaged during carpools
  • Failure of users to appear for scheduled rides
  • Any costs or damages arising from carpooling arrangements

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOWNLINC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

8. Indemnification

You agree to indemnify and hold harmless TownLinc and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your carpooling activities
  • Any dispute between you and other users

9. Insurance

If you drive as part of a carpool arrangement, you are responsible for maintaining appropriate auto insurance coverage. TownLinc does not provide insurance coverage for any carpooling activities. We strongly recommend reviewing your insurance policy to understand coverage for carpooling arrangements.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. You may stop using the Service at any time. Upon termination, your right to use the Service ceases immediately.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting updated Terms on our website. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

12. Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles.

13. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to participate in a class action lawsuit.
